These Terms & Conditions (“Terms”) govern participation in the Momkinz promotional offer of a Free 6-Month Premium Subscription (the “Promotion”). By participating, selected professionals (“Participants,” “you,” or “your”) agree to be bound by these Terms.

1. Eligibility

1.1 The Promotion is open to licensed or verified professionals who provide postpartum-related services (e.g., doulas, lactation consultants, therapists, massage therapists, fitness coaches, etc.) and are legally eligible to practice within North Carolina, USA.
1.2 Participants must be at least 18 years of age.
1.3 Employees, contractors, or immediate family members of Momkinz are not eligible.
1.4 To be considered, professionals must meet all requirements outlined in these Terms, including completion of a Call or Zoom Website Feedback Session with Dr. Manisha Ghimire, Founder of Momkinz.

2. Promotion Details

2.1 Momkinz will select 5 professionals to participate. Rewards include:

2.3 After successful completion of the session and approval of the testimonial submission, instructions on how to activate the free Premium Subscription will be sent to participants via email.
2.4 The free subscription is not transferable, not exchangeable for cash, and not substitutable with any other offer.
2.5 Chosen professionals will be notified via email or other contact information provided to Momkinz.

3. Professional Obligations

3.1 In exchange for eligibility to receive the 6-Month Premium Subscription, participants agree to:

  • Attend a scheduled Call or Zoom Website Feedback Session with Dr. Manisha Ghimire.
  • Provide honest opinions and experiences during the session.
  • Submit 1 testimonial (Google Review, Email, or Facebook) about Momkinz.

3.2 Testimonials must reflect your genuine experience, in compliance with Federal Trade Commission (FTC) Endorsement Guidelines.

4. Session & Timeline

4.1 Feedback must be provided during the scheduled session (Call or Zoom).
4.2 Sessions may be recorded (with participant’s consent) for internal review and marketing purposes.
4.3 Instructions on how to activate the Free Premium Subscription will be emailed only after successful completion of the session and testimonial.

5. Data Collection & Privacy

5.1 By participating, you consent to Momkinz collecting, storing, and using your feedback and testimonials for marketing, advertising, and promotional purposes.
5.2 Personal data will be processed in accordance with applicable U.S. privacy laws and the Momkinz Privacy Policy.

6. Intellectual Property & Usage Rights

6.1 By participating, you grant Momkinz a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute your testimonial (including your name, professional title, and likeness if submitted) across its platforms, marketing materials, and social channels.

7. Limitation of Liability

7.1 Momkinz makes no guarantees regarding business outcomes, client leads, or revenue as a result of participation in the Promotion.
7.2 Momkinz shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation.

8. Termination Rights

8.1 Momkinz reserves the right to revoke or modify this Promotion at any time, without prior notice, if fraud, technical failures, or any factor beyond its control impairs the integrity of the Promotion.
8.2 Participants who provide false, misleading, or fraudulent feedback/testimonials will be disqualified.

9. Governing Law & Dispute Resolution

9.1 These Terms are governed by and construed in accordance with the laws of the State of North Carolina and applicable U.S. federal law.
9.2 Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Wake County, North Carolina.

10. Acceptance of Terms

By confirming participation in the Promotion, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
